Terms and Conditions

1. Definitions

Goods means the supply of products or such other goods which the Buyer agrees to buy from ByChoice Online
Price means the price for the goods excluding delivery
Seller means ByChoice Online Limited (“ByChoice Online”)

2. Conditions applicable

2.1 These Conditions shall apply to all contracts for the sale of Goods by ByChoice Online to the Buyer to the exclusion of all other terms and conditions including any terms or conditions which the Buyer may purport to apply under any purchase order confirmation of order or similar document. These conditions will prevail over any other information supplied to the Buyer or displayed on our website.
2.2 All orders for Goods shall be deemed to be an offer by the Buyer to purchase Goods pursuant to these conditions any order can be refunded at any time by By Choice Online due to stock or location issues as seen fit by By Choice Online.
2.3 Acceptance of delivery/collection of the Goods shall be deemed conclusive evidence of the Buyer’s acceptance of these conditions.
2.4 Any variation to these conditions (including any special terms and conditions agreed between the parties) shall be inapplicable unless agreed in writing by ByChoice Online.
2.5 If the Buyer purchases Goods designated in writing to the Buyer as a special or made to order Goods, the Buyer understands that the Goods are obtained by the Seller on a Non-Cancellable/Non-Returnable basis; therefore, your purchase of Goods designated as special or made to order are Non-Cancellable/Non-Returnable.

3. The Price and payment

3.1 The price shall be the price set out in the order for the Goods.
3.2 Payment of the Price shall be due with the order.

4. The Goods

4.1 The quantity and description of the Goods shall be as set out in the Order.
4.2 ByChoice Online may from time to time make changes in the specification of the Goods which are required to comply with any applicable safety or statutory requirements or which do not materially affect the quality or fitness for purpose of the Goods and that all product dimensions are for use as a guideline only.

5. Warranties and liability

ByChoice Online warrants that the Goods will at the time of delivery/collection correspond to the description given by the Seller (subject to the terms of clause 4.2).

6. Delivery of the Goods

The Buyer shall make all necessary arrangements to take delivery/collection of the Goods whenever they are tendered for delivery/collection. Please note NO DELIVERY AVAILABLE TO Northern Ireland OR Republic of Ireland

7. Acceptance of the Goods

7.1 The Buyer shall be deemed to have accepted Goods 24 hours after collection by delivery to the Buyer (unless the Buyer is a Buyer defined in condition 11).
7.2 After acceptance the Buyer shall not be entitled to reject Goods which are not in accordance with the contract.

8. Title and Risk

8.1 Title shall pass on delivery/collection of the Goods.
8.2 Risk shall pass on delivery/collection of the Goods.

9. Remedies of Buyer

9.1 Where the Buyer rejects (where the Buyer is entitled to reject the Goods) any Goods then the Buyer shall have no further rights whatever in respect of the supply to the Buyer of such Goods or the failure by ByChoice Online to supply Goods which conform to the contract of sale.
9.2 Where the Buyer accepts or has been deemed to have accepted any Goods then ByChoice Online shall have no liability whatever to the Buyer in respect of those Goods.
9.3 ByChoice Online shall not be liable to the Buyer for late delivery of the Goods.
9.4 ByChoice Online shall be under no liability whatever to the Buyer for any indirect loss and/or expense (including loss of profit) suffered by the Buyer arising out of a breach by ByChoice Online of this contract.
9.5 In the event of any breach of this contract by ByChoice Online the remedies of the Buyer shall be limited to damages. Under no circumstances shall the liability of ByChoice Online exceed the Price of the Goods.

10. Supply of Goods only

10.1 The Buyer acknowledges that ByChoice Online is simply a supplier of Goods and any installation or fitting of the Goods is the sole responsibility of the Buyer, furthermore any costs arising from failure of goods ,or the late arrival of said goods once installed shall be the responsibility of the buyer, installer or manufacturer of said goods .

11. Proper Law of Contract

Sales on this website are governed by English law and you agree to submit any dispute to the non-exclusive jurisdiction of the English courts. All orders are subject to these terms and conditions and no amendments will be accepted by us. These terms and conditions do not affect your legal rights.
These terms and conditions only cover the ByChoice Online web site. Any other web sites to which you link from this site may be governed by their own terms and conditions. We accept no responsibility or liability for the content of web sites which are not under our control.

12. Cancellation and Returns Policy

If the Order consists of multiple Goods, you have 14 days to cancel the Order from the last Delivery Date.

To cancel the Order please contact Us by Telephone or Email.

If Goods have been delivered, You will be required to return them. The following conditions apply in this case:
Upon receipt and acceptance of Your cancellation request will issue You with a Return Number and a Return Address.
The cost and responsibility of returning Goods to the Return Address shall be borne by You. In the event that We supply the wrong Goods or damaged Goods to You the cost of returning the Goods shall be borne by Us.
You have 14 days from the date You are given the Return Number to return Goods to the Return Address. Failure to return Goods to the Return Address within this timeframe will render your Return Number as void.
You should not attempt to return Goods to Us or Our suppliers without a Return Number. We cannot accept returns without a valid Returns Number or at any address other than the Return Address. Failure to obtain a Return Number will result in delays processing Your cancellation and may void Your eligibility to return Goods.
You have a “Duty of Care” for any Goods delivered to You. Duty of Care requires that all Goods delivered to You are returned complete and undamaged with all accessories and instructions intact. The original packing must also be returned in reasonable condition. You will be liable for the total price of any Goods that are returned damaged or incomplete, or that otherwise do not meet the Duty of Care expectation.
We will refund the amount due to You within 14 days of the Goods being received at the Return Address. You should keep proof of postage for any Goods sent to Return Address. If You cancel the Contract prior to the despatch of the Goods, We will refund You within 14 days of receiving Your cancellation request.
Shipping charges will only be refunded in the event of faulty or goods supplied incorrectly by BYChoice Online. Part cancellation of the Order will not entitle You to a proportionate refund of Shipping charges. Any enhanced Shipping charges (for example but not limited to guaranteed next-day delivery or overseas delivery fees) are non-refundable.By Choice Online shall have no liability to you for any failure or delay in supply or delivery or for any damage or defect to goods supplied or delivered hereunder or for any other liability, in each case that is caused by any event or circumstance beyond our reasonable control (including, without limitation, accidents, extreme weather conditions, fire, explosion, flood, storm, earthquake, natural disaster, failure of telecommunications networks, inability to use transport networks, mechanical failures, acts of God, terrorist attack, war, civil commotion, riots, strikes, lockouts and other industrial disputes, acts or restraints of Government, and imposition or restrictions of imports or exports).

If an item develops a fault after 30 days following delivery or collection, and where the manufacturer has provided a helpline, repair service or warranty, you should contact the manufacturer direct. If there is no such service or warranty with the product, in most instances we will either offer a repair or where this is not possible we will replace the item with the same or an equivalent model.
